1. Purpose
These Terms & Conditions (“Terms”) govern the relationship between Flights Delayed (the “Company”, “we”, “our”, “us”) and any individual or entity (the “Client”, “Passenger”, or “User”) using our services to claim compensation under EU Regulation (EC) No 261/2004 and related laws (e.g. Montreal Convention).
By submitting a claim on our website https://www.flights-delayed.com, you agree to these Terms.
2. Scope of Service
Flights Delayed assists passengers in obtaining financial compensation and reimbursement for flight disruptions such as:
- flight delays of 3 hours or more,
- flight cancellations,
- denied boarding due to overbooking.
We act as your authorised representative or, when applicable, as an assignee of your claim, to pursue the compensation owed by the airline under applicable regulations.
3. No Win, No Fee
Our service operates on a “no win, no fee” basis:
- You pay nothing upfront.
- We only charge a success fee if the airline pays compensation.
If no compensation is obtained, you owe us nothing.
Success fee
Unless otherwise stated, our standard success fee is 30% including VAT of the total amount received from the airline.
Example:
If the airline pays €600, our fee is €180 (30% incl. VAT), and you receive €420.
4. Mandate / Assignment of Claim
To submit and manage your claim, we require your authorization.
By signing our Mandate of Representation & Collection or by confirming electronically through our website, you authorize Flights Delayed to:
- represent you in dealings with the airline,
- receive compensation on your behalf,
- deduct our success fee, and
- transfer the remaining balance to your account (IBAN).
If you prefer, you may assign your claim to Flights Delayed (cession de créance).
In that case, the compensation is paid directly to us, and we remit your balance after deducting our fee.
5. Client Obligations
By using our services, you agree to:
- Provide accurate and complete information (flight details, personal data, documents).
- Refrain from submitting the same claim to another company, lawyer, or directly to the airline.
- Notify us immediately if you receive any communication or payment from the airline.
- Sign the required authorization or assignment form when requested.
If you have already submitted a claim elsewhere, we may suspend your case until confirmation of representation is clarified.
6. Payment and Commission
When compensation is received by Flights Delayed:
- We deduct our success fee as specified above.
- The remaining amount is transferred to your IBAN within 14 business days after receipt of payment.
If the airline pays you directly without informing us, you must pay our fee within 7 days of receipt of funds, since we fulfilled our service.
All invoices include 20% French VAT.
Flights Delayed reserves the right to offset unpaid commissions against any future payments.
7. Duration and Termination
The agreement remains valid until:
- The claim is resolved and payment distributed, or
- The Client withdraws in writing before submission to the airline.
If the Client cancels after we’ve submitted the claim, or after an offer has been made by the airline, the success fee remains due.
8. Limitation of Liability
Flights Delayed shall not be held liable for:
- Incorrect or incomplete data provided by the Client,
- Airline insolvency or refusal to pay,
- Delays caused by authorities or extraordinary circumstances,
- Consequential damages (loss of time, moral prejudice, etc.).
Our total liability shall not exceed the amount of our success fee for the claim concerned.
9. Data Protection (GDPR)
Flights Delayed complies with the General Data Protection Regulation (EU) 2016/679 (GDPR).
We collect and process your data only to:
- handle your claim,
- contact airlines and authorities,
- and manage financial transactions related to your case.
Data retention
Data is stored securely within the EU for a period of 5 years after case closure, then deleted.

10. Communication and Authorization
All communications between Flights Delayed and the Client shall be conducted by email or secure web portal.
Documents, authorizations, and confirmations submitted electronically (e.g. via checkbox, form submission, or e-signature) have the same legal value as a handwritten signature.
11. Jurisdiction and Applicable Law
These Terms are governed by French law.
Any dispute that cannot be settled amicably shall be submitted to the competent courts of Paris (France).
